    OMBUDSMAN EXTENDS SUPPORT TO ARMENIAN PAPER

    The Armenian ombudsman has expressed solidarity with the Zhoghovurd
    newspaper in connection with the libel lawsuit filed by the Yerevan
    Poultry Plant owner.

    In a statement, Karen Andreasyan condemns the district court judge for
    what he claims to be an unlawful ruling against the paper. "The media
    outlet is now facing the threat of closedown because of a first
    instance court judge, who has passed an unlawful verdict conflicting
    with not only a legally binding ruling by Armenia's Constitutional
    Court but also several norms of international law.

    The Constitutional Court has ruled that 'the courts have to consider
    the means and earnings of a journalist while deciding the
    appropriateness of the compensation claim in order to avoid imposing
    an excess burden on the latter.

    Such rulings later cause a huge material and moral damage to our state
    in the Strasburg Court [European Court of Human Rights].

    Any judge in Armenia allows himself or herself to pass an unlawful
    ruling or verdict because the blatantly unlawful move is not always
    likely to be reversed by the Constitutional Court, with the Council of
    Justice often failing to demand accountability from the judge.

    A judge can be independent of each and every person, except the
    'powerful' members of those two bodies," says the ombudsman.

    The owner of the Yerevan Poultry Plan, Khachik Khachatryan, filed the
    lawsuit against Zhoghovurd earlier this month in connection with a
    December report accusing the company of selling eggs which were past
    the sell-by date.
