LAWYER: IN ACCORDANCE WITH ARMENIAN LEGISLATION, VALERY PERMYAKOV MAY FACE 12-20 YEARS IN JAIL OR LIFE IMPRISONMENT

In accordance with the Armenian legislation, if found guilty,
Russian serviceman Valery Permyakov, who has murdered a family of
six in Gyumri, may face 12- 20 years in jail or life imprisonment,
Marianna Yeghiazaryan, a well-known lawyer in Armenia, has told
ArmInfo's correspondent.
She says that if the Russian court considers the case, the suspect
may face 8-20 years in jail or life imprisonment under Article 105 of
the Russian Criminal Code. She says that in the cases when a citizen
of a country commits a crime in another country, the Armenian-Russian
agreement on jurisdiction and mutual legal support is applied. Under
the agreement, the parties also cooperate on issues of extradition. In
this context, the lawyer stressed that in any case the concerned party
is to apply in the written form within a certain period of time to
the relevant bodies of the country, where the crime has been committed.
"That is to say, the Russian party has the right to apply to the
relevant bodies of Armenia to receive materials of investigation,
however, the Armenian party has the right to deny the access to
the materials, because this may damage the country's security and
sovereignty", she says.
The lawyer points out that at the initial stage the two countries'
prosecutors' offices should handle the Permyakov case. She says that
according to the Agreement on military cooperation and legal support
in cases related to dislocation of the Russian military base in
the Republic of Armenia, if the criminal is a military serviceman,
he is to be transferred to Russia. "However, it is a controversial
standard, because Armenia can transfer him not at once, i.e. it can
launch pretrial investigation", she says.
On January 13, Deputy Head of Armenian Police Hunan Poghosyan said
that the Russian serviceman admitted to the murder of the Avetisyans'
family in Gyumri. Poghosyan added that Permyakov stays in the
territory of the Russian military base. He also pointed out that
Russia is inclined to submit the criminal case for investigation of
the Armenian law-enforcement agencies.
As was reported earlier, on Jan 12 in Gyumri, Permyakov left his post.
He penetrated into the house of the Avetisyans and shot all the 6
members of the family dead. Only their 6-month-old baby has survived.
The soldier left his uniform and gun at the scene. He escaped wearing
casual clothing. After a day-long search, he was detained on the
border with Turkey
