EUROPEAN COURT IS NEITHER A SOURCE OF FINANCE NOR A THIRD INSTANCE

"The European Court of Human Rights (ECHR) registers all kinds of
legal violations but it does not fix a material compensation for all,"
the Armenian government representative to the European Court says with
an expectation that citizens realize that the European Court is not a
source of funds. For example a citizen of Armenia has applied to the
ECHR on Nikoghosyan and Melkonyan against Republic of Armenia Case
with a request for compensation in the amount of 13,800 Euro. He did
so without being informed about a hearing at the Review court and was
striped off his right for participation. The European Court considered
that there is a fact of violation but accepting the suggestions
submitted by the government did not define any material compensation.
Deputy justice minister, and the authorized representative of the
Armenian government to the European Court, Gevorg Kostanyan, assured
that the citizens has been variously suggested ways for recovery of
his rights but he after all applied to the European Court. This makes
Kostanyan believe that the main aim is to get money.
