    ACCORDING TO SPEAKER OF NATIONAL ASSEMBLY, DECISION OF "HERITAGE" NOT TO PARTICIPATE IN FIRST SITTING OF NEWLY ELECTED PARLIAMENT CONTRADICTS LAW AND CONSTITUTION

    YEREVAN, JUNE 7, NOYAN TAPAN. "Zharangutyun" ("Heritage") party
    informed the speaker of the RA National Assembly Tigran Torosian
    in writing that it will not participate in the first sitting of the
    National Assembly of fourth convocation on June 6.

    The letter in particular reads: "The first sitting of the NA of
    fourth convocation has not yet been held: until now "Heritage" has not
    received a notice about this sitting and other details - in the manner
    appropriate for a legal state. Moreover, the Constitutional Court is
    now examining the issue of ratification of the NA elections, which
    must receive its solution by June 10, 2007. Based on these arguments,
    "Heritage" informs you about the impossibility of its presence at NA
    sittings prior to solution of the above mentioned problems."

    According to the RA National Assembly PR Department, on the same
    day the RA NA speaker Tigran Torosian had a telephone conversation
    with the leader of "Heritage" party Raffi Hovannisian and said that
    "these explanations cannot be grounds for not participating in the
    work of the session of the NA of fourth convocation."

    T. Torosian explained that Mr. Hovannisian's letter is misaddressed:
    the speaker of the NA of third convocation has no relation to
    problems of the NA of fourth convocation, and there is no tradition in
    Armenia to invite factions to the first session of the newly elected
    parliament or to notify them. The Constitution and the RA Law on Rules
    of Procedure of the Naional Assembly stipulate when this session shall
    take place. It is obvious that the issue of invitation to the first
    session of the NA is not conditioned by any circumstance, including
    by issues examined by the Constitutional Court.

    Therefore, according to T. Torosian, the requirement of Article 34 of
    the RA Law on Rules of Procedure of NA is holding the first session of
    the newly elected NA within the specified period and the participation
    of deputies in it.
